Content and Intellectual Property

Your Content

You retain all ownership rights to content you create, upload, or provide to PostSMore ("Your Content"). By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to:

Use Your Content to improve our AI models and Service (you may opt-out by contacting us)

Create backups and cached copies for reliability and performance

This license terminates when you delete Your Content or close your account, except for content that has been shared with others or is required for legal purposes.

PostSMore and all related logos, designs, text, graphics, software, and other content (excluding Your Content) are owned by us or our licensors and protected by intellectual property laws. You may not use our trademarks, service marks, or logos without our prior written consent.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation or compensation to you.

AI-Generated Content

Nature of AI Content

Important disclaimers regarding AI-generated content:

Non-Deterministic: AI models are non-deterministic and may produce different outputs for similar inputs
No Guarantees: We do not guarantee the accuracy, quality, or suitability of AI-generated content
Review Required: You are responsible for reviewing and editing all AI-generated content before publishing

Your Responsibility

You acknowledge and agree that:

Subscriptions and Billing

AI-generated content will meet your requirements or expectations

Third-party services will continue to function or remain available

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTSMORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

We are not responsible for third-party services, including AI providers, social media platforms, payment processors, or hosting providers. Your use of third-party services is at your own risk and subject to their respective terms.

Indemnification

You agree to indemnify, defend, and hold harmless PostSMore, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Content you create, upload, or publish through the Service
